Terms & Conditions — Software Sales Policy

1 Definitions

• A1-Soft (الشركة) — A1-Soft, the owner and developer of the software covered by this document, based in the State of Kuwait.
• Software / Product — any application, cloud service, or licence offered by the Company within the products list set out below.
• Trial (Demo) Period — the free period designated for trying and evaluating the Product before purchase.
• Licence — a limited, non-exclusive, non-transferable right of use granted to the Customer per the plan and paid term.
• Customer — the natural or legal person who acquires the licence or uses the Product.

2 Covered Products

The provisions of this policy apply to all A1-Soft products listed below. Prices shown are starting-from figures and may vary by number of users, term, and geographic region; the final amount is computed at checkout.

3 Licensing & Subscription

• The licence is granted on a paid subscription basis (monthly, annually, or per the selected plan), calculated per user, device, or unit according to the nature of the Product.
• The licence is personal and bound to the Customer; it may not be sold, leased, assigned, or shared with third parties without the Company's prior written consent.
• Some products are bound to the activation device (hardware-bound) and are activated online once.

4 Trial (Demo) Period & Pre-Purchase Use Terms

The Company offers, for most of its products, a free trial period (up to thirty days for cloud platforms and fourteen days for desktop software) enabling the Customer to try the Product and inspect all of its features, performance, and suitability for their needs before deciding to purchase. The Company advises the Customer to make full use of this period to thoroughly evaluate the Product.

Use rules during the trial period:

• The trial is provided on an as-is basis for evaluation purposes only, and may include limitations on certain features, capacity, or duration.
• All Acceptable-Use rules and the prohibition on copying and reverse-engineering set out in this document apply to the trial period.
• Reliance on the trial version in a live production environment is not advised; data entered during the trial may not be retained after it ends, or may be deleted.
• The trial expires automatically at the end of its period unless a paid licence is activated.

5 Pricing, Currency & Taxes

• Prices are shown in the currency corresponding to the Customer's region; the final amount is determined at checkout based on the Product, number of users, and term.
• The Company reserves the right to amend prices without prior notice, provided that no amendment applies to an active paid subscription until the end of its term.
• Prices exclude any taxes or government fees that may be levied in the Customer's country, which are borne solely by the Customer if applicable.

6 Payment

Payments are processed securely through the authorised payment provider (LemonSqueezy); Visa, Mastercard, and Apple Pay are accepted, and the Company stores no card data on its servers.

The licence is activated upon confirmation of payment. Should electronic payment fail, the Company will contact the Customer to complete the process manually.

7 Refund Policy

• Given that a free trial is provided to inspect the Product before purchase, the refund does not cover any claim relating to a feature or behaviour that could have been verified during the trial.
• The refund does not cover subscription periods consumed after fourteen days, nor custom services or development hours already delivered at the Customer's request.
• To submit a refund request, please contact the Company by email or WhatsApp, quoting the order reference.

8 Renewal & Cancellation

• Subscriptions renew per the chosen cycle; the Customer may cancel renewal at any time before the due date, and the licence remains in force until the end of the paid term.
• Upon expiry of the subscription without renewal, access to the service stops or the Product enters a limited mode according to its nature.

9 Updates & Mandatory Updates

Periodic security and functional updates are provided throughout the subscription. The Company may require the Customer to perform a mandatory update to a newer version for security or compatibility reasons; in such case the older version may cease to operate until the update is completed.

10 Acceptable Use

• The Product may not be used for any unlawful purpose, to infringe the rights of others, or to attempt to breach or misuse the service.
• Copying, redistributing, decompiling, reverse-engineering the Product, or removing its protection and licensing systems is prohibited.

11 Intellectual Property

All rights in the software — including source code, designs, and trademarks — vest solely in the Company. The licence grants the Customer no proprietary right in the Product, but only a limited right of use.

12 Privacy & Data

The Company collects the minimum data necessary to provide the service and manage the licence (such as name, email, and device identifier), and does not sell the Customer's data to any third party. Data is processed in accordance with the Company's applicable privacy policy.

13 Warranty Disclaimer & Limitation of Liability

The Product is provided on an as-is basis without any implied warranties of being entirely error-free or fit for a particular purpose. The Company shall not be liable for any indirect or consequential damages, and its maximum liability is limited to the amount paid during the last twelve months.

14 Termination

The Company may suspend or terminate the licence upon breach of these Terms or default in payment of dues; upon such termination, the Customer's right to use the Product lapses immediately.

15 Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Kuwait, and the courts of Kuwait shall have exclusive jurisdiction to adjudicate any dispute arising therefrom.

16 Amendment of Terms

The Company may update these Terms from time to time; the Customer's continued use of the Product after the amendments are published constitutes acceptance thereof. Please review this page periodically.
